TERMS OF CLEARANCE The Survey of Occupational Injuries and Illnesses (SOII), conducted by the Bureau of Labor Statistics, is a Federal/State cooperative program that publishes estimates on nonfatal occupational injuries and illnesses. Each year, approximately 200,000 employers report for establishments in private industry and the public sector (state and local government). As such, the SOII is the primary indicator of the Nation's progress in providing every working person safe and healthful working conditions. Survey data are also used to evaluate the effectiveness of Federal and State programs and to prioritize scarce resources. Respondents include employers who maintain Occupational Safety and Health Administration (OSHA) records in accordance with the Occupational Safety and Health Act and employers who are normally exempt from OSHA recordkeeping. Each year a sample of exempt employers is required to keep records and participate in the survey. The updated SPD 15 is effective as of March 2024 and requires all existing Federal information collections to comply as soon as possible. Accordingly, it is important that the SOII comply with the updated SPD 15 as quickly as possible. In this Information Collection Request (ICR), BLS indicates that the SOII is not able to comply with the updated race/ethnicity data standards at this time and, instead, says that the agency will begin implementing the updated race/ethnicity data standards into the SOII’s next biennial period starting with reference year (RY) 2027 collection that begins in January 2028. In the ICR, BLS also states, “Data collected for the RY 2027 SOII will be combined with data from the RY 2028 SOII to produce biennial estimates of nonfatal occupational injuries and illnesses, including worker demographics reflecting the new race and ethnicity standards. These RY 2027-28 biennial SOII case and demographic estimates using updated race and ethnicity will be published for the first time in November 2029.” BLS continues to explain that it must first implement major updates to data collection processes and systems for the Occupational Injury and Illness Classification System (OIICS) coding taxonomy and the 2022 revision for the North American Industry Classification System (NAICS). OMB grants approval for this ICR for 1 year under the following conditions. The Bureau of Labor Statistics will: (1) By or before April 29, 2025 (6 months from this clearance), provide a written update to OMB that includes: (1a) A draft SOII action plan describing how the data collection will comply with the 2024 SPD 15 as soon as possible, by or before January 2028, and publication thereafter, and (1b) A communications strategy describing how the agency has been/will continue to meaningfully engage with stakeholders about how the SOII is working toward compliance with the updated data standards. (2) By or before August 29, 2025 (10 months from this clearance), provide a written update to OMB that includes the final SOII action plan describing how data collection will comply with the 2024 SPD 15 as soon as possible, by or before January 2028, and publication thereafter.
