Abstract:
The U.S. Department of the Interior (Department), Office of the Assistant Secretary for Indian Affairs, proposes to revise the regulations that implement Tribal Self-Governance, as authorized by title IV of the Indian Self Determination and Education Assistance Act. This rule has been negotiated among representatives of Self-Governance and non-Self Governance Tribes and the Department. The intended effect is to revise the regulations that allow for transfer to participating Tribes of control of, funding for, and decision making concerning certain Federal programs. Tribes interested in entering into Self-Governance must submit certain information required by Tribal Self Governance Act of 1994, 25 U.S.C. 5361-5368, to support their admission into Tribal Self-Governance. In addition, those Tribes and Tribal consortia that have entered into Self-Governance compacts may be requested to submit certain information to justify budget requests on their behalf and to comport with Section 405 of the Act that calls for the Secretary to submit an annual report to the Congress.
