Abstract:
This ICR renewal is for the mandatory reporting of foreign motor carriers to report information to FMCSA on an annual basis using the OP-2 form in order to operate in the United States. This collection of information is used by the FMCSA to register foreign motor carriers to operate across the Mexico- U.S. border into the United States in accordance with 49 U.S.C. 13902(c) and 49 CFR 368. Data contained on the Form OP-2 will provide the FMCSA with evidence to assess the foreign (Mexico-based) motor carrier’s safety program and its ability to comply with U.S. safety standards. It also provides information concerning changes in each carrier’s operating status to ensure actual compliance with safety requirements. This enables the Agency to maintain an accurate census of registered carriers and ensure safety. There is an increase in the number of respondents and in the burden hours calculated for this renewal. The annual burden hour increase of 831 is due primarily to the increase in the number of updated OP-2 forms filed from 2020 through 2022. The average number of entities which filed updated OP-2 forms in the three-year period 2020 and 2022 increased by 95 percent, compared to the number that registered from 2017 through 2019.

The respondent burden hours have increased by 831 hours for this renewal (878 hours proposed – 47 hours currently approved = 831 hours). The change is due to an increase in the number of respondents who updated the OP-2 applications. An estimated 585 respondents will incur a labor total cost of $37,549 annually. This is an increase from the $2,196 cost incurred previously. This is due to an increase in burden hours.
