Terms of Clearance:
No later than 3/31/2025, the agency shall develop and provide to OIRA a plan that assesses the feasibility of translating all associated instruments into additional languages (other than English and Spanish) in order to increase accessibility. As part of this feasibility assessment, the agency may assess linguistic preferences across the respondent population or assess translating into the top languages as spoken by more than 1 million individuals (in addition to Spanish and English) identified by the 2019 ACS Language Use Report (French, Chinese, Korean, Vietnamese, Tagalog, Arabic). To the extent available, this plan shall specify the potential languages for translation, identify possible translation service providers, discuss any necessary system changes to accommodate the use of these translated forms, and establish a possible timeline with milestones for deliverables. The feasibility assessment will also include, to the extent available, high-level budgetary and staffing resources needed to undertake any additional translations and a CMS leadership recommendation of whether such additional translations are feasible and on what timeline. Should additional translated forms be developed as a result of this feasibility study and CMS leadership recommendation, the agency may submit non-substantive change requests to incorporate them into this information collection request (ICR). The agency is strongly encouraged to adopt translations as soon as practicable. This translation request is supported by the principles and priorities set forth in the memorandum titled “Improving Access to Public Benefits Programs Through the Paperwork Reduction Act” (April 13, 2022), the Executive Order 13985 on “Advancing Racial Equity and Support for Underserved Communities Through the Federal Government” (January 20, 2021) and the Executive Order 13166, "Improving Access to Services for Persons with Limited English Proficiency" (August, 11, 2000). Additionally, prior to the next extension or revision of this ICR, the public burden statement on each instrument shall be updated to include language that provides all of the information required per 5 CFR § 1320.8(b)(3). As part of this update, OMB has agreed to work with CMS to reconcile these new requirements with other, existing consumer experience obligations. Pending finalization of the CMS/OMH data collection instrument, the next submission of this ICR will be evaluated for alignment with that approved data collection guidance to implement the White House Recommendations on the Best Practices for the Collection of Sexual Orientation and Gender Identity (SOGI) Data on Federal Statistical Surveys. CMS will brief OIRA on this alignment, the empirical evidence supporting CMS’s decision, and CMS’s implementation strategy. Finally, prior to the next extension or revision of this ICR, the agency shall update the race/ethnicity question in this information collection to be in compliance with the updated SPD 15 (effective as of March 28, 2024). The agency shall aim to effectuate the SPD 15 update to this ICR through a non-substantive change request for Open Enrollment 2026, barring operational and other circumstances that prevent the agency from doing so. In the event that such circumstances occur, the agency shall effectuate this SPD 15 update through a non-substantive change request no later than Open Enrollment 2027.

Abstract:
Section 1413 of the Affordable Care Act directs the Secretary of HHS to develop and provide to each State a single, streamlined form that may be used to apply for coverage through the Exchange and Insurance Affordability Programs. A state may develop and use its own single streamlined application if approved by the Secretary in accordance with section 1413 and if it meets the standards established by the Secretary.
