Abstract:
FSA proposes amending a provision in its National Environmental Policy Act (NEPA) regulation. FSA is clarifying a categorical exclusion related to small and medium CAFOs. Small and medium CAFOs have implicitly been categorically excluded by the Farm Service Agency (FSA) since FSA revised the NEPA regulations in 7 CFR 799 in 2016. The regulation has a process by which small and medium CAFOs are properly reviewed under NEPA using FSA’s Environmental Screening Worksheet.
