FNS is merging provisions from three proposed rules - the Child and Adult Care Food Program: Amendments Related to the Healthy, Hunger-Free Kids Act of 2010 rule (0584-AE12); most of the monitoring provisions within the Simplifying Meal Service and Monitoring Requirements in the National School Lunch and School Breakfasts rule (0584-AE67), and the CN Program Integrity Rule (0584-AE08). The merged provisions will be incorporated into a single final rule to be published in Summer 2023 as the CN Program Integrity Final Rule (0584-AE08). Of note, FNS will no longer be pursuing rulemaking as a separate action for 0584-AE12 or 0584-AE67.

This rule will: 1) establish criteria for imposing fines against schools, school food authorities, or State agencies that fail to correct severe mismanagement of the program or repeated violations of program requirements; 2) streamline monitoring requirements to support State agencies’ technical assistance efforts; 3) Allow States to focus on SFAs’ implementation of the Child Nutrition Programs and provide any assistance that is needed for SFAs to improve program operations.
