Title: Forest Products for Traditional and Cultural Purposes (Rule) 
Abstract:

The current regulations at 36 CFR part 223, subpart A, do not include the authority to grant trees, portions of trees, or forest products to federally recognized Indian tribes, free of charge, for non-commercial traditional and cultural purposes (pursuant to sections 8102 and 8105, Pub. L. 110-246, 122 Stat. 1651 (2008)). However, during the regulation promulgation process, Forest Service officials currently are providing such products, subject to their delegation of authority under 36 CFR 223.8 (per an interim directive issued on December 2, 2009, to FSH 2409.18, chapter 80 (ID-2409.18-2009-2)). The delegation of authority under 36 CFR 223.8 does not limit the quantity or value of what the federally recognized Indian tribe may request; it simply states which Forest Service official may actually authorize the Indian tribe's request (based on product value).
