| Title: ●Amending the Department of Commerce's Title IX Regulations to Conform More Closely With the Statutory Text and Remove Disparate-Impact Provisions | |

Abstract:
By this rule, the Department of Commerce (Department) amends its regulations implementing Title IX of the Education Amendments of 1972, as amended (except sections 904 and 906 of those Amendments) (Title IX). This rule eliminates provisions promoting disparate impact liability and affirmative action. This action is necessary to reduce regulatory uncertainty for recipients of Federal financial assistance and to align the Department’s regulations with the original public meaning of Title IX. The intended effect is to provide greater clarity for recipients while maintaining the core prohibition against intentional discrimination on the basis of sex. |
