| Abstract: This rule would amend the regulations of the Department of Commerce's (the Department) Import Administration (IA) that relate to the filing requirements in antidumping (AD) and countervailing duty (CVD) proceedings. This amendment would allow interested parties to AD/CVD proceedings to submit their documents related to those matters electronically through the Import Administration Antidumping and Countervailing Duty Centralized Electronic Service System (IA ACCESS). Specifically, the rule would change the filing requirements under 19 CFR 351.303(c)(1), which normally require parties to manually file one original and five paper copies of public submissions for AD/CVD proceedings. Where the submission contains business proprietary information, the rule currently allows parties to file one original and five copies of a business proprietary submission, and three copies of the public version, to the Department. Through this amendment, parties will file all submissions electronically via an internet connection. Parties seeking to manually file submissions must demonstrate that they meet an exception to the electronic filing rule, and such exceptions will be granted only with prior approval, on a case-by-case basis. A party that is allowed to file a manual submission will nonetheless need to file only one hard copy of the submission, along with a cover page that is generated using IA ACCESS. Because this cover page and submission are part of an administrative proceeding before the Department, it is not subject to the Paperwork Reduction Act. Additional proposed amendments to the regulations are directed at amending provisions where manual filing or paper copies of submissions are discussed in order to refer instead to the electronic filing requirement or electronic format of the submissions. The rule would also includes minor corrections and clarifications related to filing procedures. | |
