| Title: ●Western and Central Pacific Fisheries for Highly Migratory Species; Restrictions on Fishing in Proximity to Data Buoys | |
| Abstract: Pursuant to the Western and Central Pacific Fisheries Convention Implementation Act, the Secretary of Commerce is authorized to implement regulations to carry out the obligations of the United States under the Western and Central Pacific Fisheries Convention (Convention), including the implementation of decisions of the Western and Central Pacific Fisheries Commission (Commission). At its Sixth Regular Session, in December 2009, the Commission adopted a conservation and management measure (CMM) to restrict fishing on and near data buoys in the Commission's area of competence, CMM 2009-05 Conservation and Management Measure Prohibiting Fishing on Data Buoys. This rule would implement the following provisions of CMM 2009-05: Prohibit highly migratory species (HMS) fishing vessels of the United States, while on the high seas in the Commission's area of competence, from fishing within one nautical mile of a data buoy and from interacting with a data buoy through activities such as encircling a data buoy with fishing gear, tying up to or attaching the vessel, or any fishing gear, part or portion of the fishing vessel, to a data buoy or its mooring, or cutting a data buoy anchor line; prohibit HMS fishing vessels of the United States from taking on board a data buoy while in the Commission's area of competence; and require HMS fishing vessels of the United States that become entangled with data buoys while in the Commission's area of competence to remove the entangled fishing gear with as little damage to the data buoy as possible. This rule would also correct outdated cross references to other regulations that are in the existing 50 CFR part 300 subpart O. | |
