This emergency rule allows Bering Sea Tanner crab to be custom processed at a facility through contractual arrangements with the facility owners without that crab being applied against the individual processor quota (IPQ) use cap of the facility owners. IPQ use caps limit the amount of crab processors can process in one season. The Council and NOAA Fisheries recently discovered that due to processor consolidation, the only available processors are constrained by the IPQ use caps and approximately 10 percent of the Tanner crab allocations could not be legally processed. The Council determined, and NOAA Fisheries agrees, that this emergency rule was needed to prevent substantial economic harm to fishery participants by allowing the complete harvesting and processing of Tanner crab allocations during the 2015/2016 crab fishing year.
