Abstract:
The purpose of this framework action is to move from the expired 3G cellular electronic logbook (cELB) program to a system that would maintain the Gulf Council’s and National Marine Fisheries Service’s (NMFS) scientific ability to estimate and monitor fishing effort in the Gulf shrimp fishery while minimizing the economic burden on the industry and on the agency to the maximum extent practicable. The framework action would modify the current data collection program by requiring the owner or operator of a vessel with a shrimp moratorium permit, if selected by NMFS, to install a cELB device that has been type-approved for the Gulf shrimp fishery, which archives vessel position when on a shrimp fishing trip in the Gulf and automatically transmits that data via cellular service to NMFS. The Gulf Council is developing this action consistent with the authority in Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act) section 303(a)(5) (requiring that FMPs specify data to be submitted with respect to commercial, recreational, charter fishing, and fish processing in the fishery). The NMFS would implement this proposed action consistent with the authority in section 304(b) of the Magnuson-Stevens Act. |
