| Abstract: The United States Court of Appeals for the Federal Circuit issued a decision in Agilent Technologies, Inc. v. Affymetrix, Inc., 567 F.3d 1366 (Fed. Cir. 2009). That decision impacted the continuing viability of portions of 37 CFR 41.200(b)(2004). The United States Patent and Trademark Office (USPTO or Office) is therefore canceling the affected portion of the interference rule. | |
