Title: ●Interpretation of NTIA's Authority regarding FirstNet Fees under Parts of the Middle Class Tax Relief and Job Creation Act of 2012  
Abstract:

This action would implement regulations, interpretations and procedures relating to the Middle Class Tax Relief and Job Creation Act of 2012 (Pub. L. No. 112-96, Title VI, 126 Stat. 256 (codified at 47 U.S.C. 1401 et seq.) (the Act) and NTIA’s fee-related duties with respect to the First Responder Network Authority (FirstNet).  Congress required FirstNet to be permanently self-funding, and authorized it to assess and collect certain types of fees to, at least in part, assure its solvency. Congress required that, annually, the total amount of FirstNet’s fees must be sufficient, but shall not exceed the amount necessary, to recoup FirstNet’s total expenses in carrying out its duties under the Act. As part of FirstNet’s self-funding obligations, Congress charged NTIA with reviewing FirstNet’s fees on an annual basis; such fees may only be assessed if approved by NTIA. Through this action, NTIA would implement a framework for NTIA’s review of fees.
