| Title: ●Updated Statements of Legal Authority To Reflect Continuation of Emergency Declared in Executive Order 12938 | |
| Abstract: In Executive Order 12938, of November 14, 1994 (59 FR 59099, 3 CFR, 1994 Comp., p. 950), the President declared a national emergency with respect to the unusual and extraordinary threat to the national security, foreign policy and economy of the United States posed by the proliferation of nuclear, biological and chemical weapons and the means of delivering such weapons. The authority for parts 730, 734, 736, 742, 744 and 745 of the Export Administration Regulations (15 CFR parts 730, 734, 736, 742, 744 and 745) is based in part on Exectuve Order 12983 (as amended) and successive annual notices in which the President continued the emergency declared in that Executive order. The authority conveyed by most recent such notice will expire on November 14, 2010. BIS expects that, before such expiration, the President will issue a notice continuing the emergency declared in Executive Order 12938 for another year. This rule updates the authority citations paragraphs for parts, 730, 734, 736, 742, 744 and 745 of the EAR to include a citation to the notice that BIS expects the President to issue. The rule updating the authority citations must be published in 2010 for those citations to be included in the January 1, 2011 compilation of Title 15 of the Code of Federal Regulations. This rule makes no changes to the text of the EAR. This rule will not alter any right, obligation or prohibition that currently applies to any person under the EAR. | |
