Abstract:
The Bureau of Industry and Security (BIS) amended the Export Administration Regulations (EAR) to reflect decisions adopted by the Australia Group (AG) export control regime at its Plenary meeting in Paris in June 2019. Specifically, this rule amended Export Control Classification Number (ECCN) 1C991 on the Commerce Control List (CCL), which controls certain vaccines, immunotoxins, medical products, and diagnostic and food testing kits. Consistent with these AG decisions, this rule clarifies the scope of ECCN 1C991 to indicate that it includes not only vaccines against, but also those containing, any of the items identified in ECCN 1C351, 1C353 or 1C354. Previously, the AG common control list that contains these items was not specific as to whether the vaccine release (i.e., exclusion) note therein applied to vaccines containing the genetic elements and genetically modified organisms on the list that are also identified in ECCN 1C353 on the CCL. |
