Abstract:
On January 16, 2025, the Bureau of Industry and Security (BIS) published an interim final rule (Biotech IFR) that imposed new controls on certain biotechnology equipmentspecifically, high parameter flow cytometers and liquid chromatography mass spectrometers specially designed for top-down proteomics. Informed by public comments received, the agency’s independent analysis, and recent Presidential deregulatory guidance, BIS has decided to revoke the Biotech IFR’s control on high parameter flow cytometers because they are widely available in foreign markets, and the restrictions would cede the U.S.’s market share to countries of concern that produce these items, thus undermining U.S. national security interests. BIS is retaining the Biotech IFR’s control on certain mass spectrometers because foreign availability of those items has not been identified. This final rule also responds to the comments received under the Biotech IFR and makes clarifying changes and technical corrections. |
