Title: Award Fee Contracts (DFARS Case 2006-D021)
Abstract: This rule amended the Defense Federal Acquisition Regulation Supplement (DFARS) to address the appropriate use of award and incentive fees in DoD acquisitions, by revising the guidance for award-fee evaluations and payments, eliminating the use of provisional award-fee payments, and incorporating DoD policy guidance on the use of objective criteria. A new clause entitled Award Fee sets forth the use of award fees in DoD contracts. Most contracts awarded to small entities use simplified acquisition procedures or are awarded on a competitive fixed-price basis and do not utilize award-fee type incentives. Therefore, DoD expects that the economic impact will be minimal.
