View Rule

This rule establishes policy, assigns responsibilities, and prescribes procedures for the screening of the Reserve Component (RC) to ensure the RC is available for activation and is immediately available for active duty. This rule also describes procedures for Reserve Component general screening requirements; and outlines procedures for the annual federal key employee screening program, where Federal agencies annually screen their designated key positions to verify if the positions are occupied by Ready or Standby Reserve members; and provides information on how to request removal from the Ready Reserve and a sample format for a mobilization Exemption, Deferment, or Delay Request.

The rule directs the Assistant Secretary of Defense for Manpower and Reserve Affairs (ASD(M&RA)) to coordinate the screening program with employers of Ready Reserve members and coordinate key employee appeals and other conflicts identified but not resolved through the screening process. The Secretaries of the Military Departments and the Commandant of the USCG will continuously screen the RC to ensure immediate availability for active duty and review recommendations submitted by employers for removal from the Ready Reserve and take applicable action. Members of the Ready Reserve who are key employees and are not designated by the Secretary of the Military Department concerned or Commandant of the USCG as a member to be retained in the Ready Reserve will be transferred to the Standby or Retired Reserve or discharged, as applicable.
