| Title: Health Center Federal Tort Claims Act (FTCA) Medical Malpractice Program Regulations--Clarification of FTCA Coverage for Services Provided to Non-Health Center Patients | |
| Abstract: The Bureau of Primary Health Care (BPHC) of the Health Resources and Services Administration (HRSA) proposes amending regulations at 42 CFR part 6 ("FTCA Coverage of Certain Grantees and Individuals") to include additional examples of Federal Tort Claims Act (FTCA)-covered activities. Recently, questions have arisen regarding the scope of FTCA regulations as they affect medical malpractice coverage for FTCA-deemed health centers and non-health center patients. Section 6.6(e) of the Health Center FTCA Program regulations provides examples of situations within the scope of section 6.6(d) (which authorizes FTCA medical malpractice coverage for non-health center patients). These examples include certain community-wide interventions and hospital-related activities where the health centers health care practitioners will be covered for services provided to non-health center patients. | |
