| Title: Long-Term Care Facility Quality Assessment and Performance Improvement Dementia Management and Abuse Prevention Training (CMS-3231-P) | |
| Abstract: This proposed rule would implement section 6102 of the Affordable Care Act by amending the requirements that an institution must meet to participate as a skilled nursing facility (SNF) in the Medicare program, or a nursing facility (NF) in the Medicaid program. This proposed rule would require these long term care (LTC) facilities to develop, implement, and maintain a quality assessment and performance improvement (QAPI) program. In addition, this proposed rule would also amend the requirements that an institution must meet in order to qualify to participate as a SNF in the Medicare program, or as a NF in the Medicaid program, by requiring the current mandatory on-going training requirements for nurse aides (NA) to include dementia management and resident abuse training. This proposed rule would also clarify that the definition of NA includes an individual who provides services through an agency or under contract with a SNF or NF. Finally, this proposed rule would address section 6121 of the Affordable Care Act which requires facilities to include dementia management and abuse prevention training as part of pre-employment initial training for permanent and contract or agency staff, and if the Secretary determines appropriate, as part of ongoing in-service training. | |
