HHS/CMS RIN: 0938-AU73 Publication ID: Spring 2022
Title: Reassignment of Medicaid Provider Claims (CMS-2444)
Abstract:

This final rule reinterprets statutory language to allow states to make Medicaid payments to a third party on behalf of an individual Medicaid practitioner for benefits such as health insurance, skills training, and other benefits customary for employees, if the practitioner has consented to such payments.  This final rule is in response to a 2020 court ruling that vacated a 2019 final rule, which had removed regulatory text allowing a state to make these third-party payments.
