Abstract:

The Department of Health and Human Services (HHS or Department) plans to issue a notice of proposed rulemaking (NPRM) to solicit comment on proposals to modify the Standards for Privacy of Individually Identifiable Health Information (Privacy Rule) under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the Health Information Technology for Economic and Clinical Health Act of 2009 (HITECH Act). The proposals would address the amount of time that covered entities have to respond to requests for protected health information (PHI) made pursuant to the right of access.
