| Title: Dedicated Accounts and Installment Payments for Certain Past Due SSI Benefits (622F) | |
| Abstract: These regulations reflect amendments to the Social Security Act made by sections 213 and 221 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996. Section 213 requires the establishment of accounts in financial institutions for the payment of past due SSI benefits after reimbursement to a State for Interim Assistance Reimbursement (IAR) exceeding 6 months benefits to representative payees on behalf of children under age 18. These accounts will be dedicated for certain purposes by restrictions on the use of such past due benefits. Section 221 requires past due SSI benefits after reimbursement to a State for Interim Assistance Reimbursement that equals or exceeds 12 months benefits to be paid in installments with certain exceptions. These regulations also reflect amendments to the SSPA made by section 302 of the Social Security Protection Act of 2004, effective May 2005, which provides for the payment of attorney fees by SSA from past due benefits that are payable to an individual. Section 7502 of the Deficit Reduction Act of 2005, enacted February 8, 2006, changed the formula for the payment of SSI installments. The new formula states that when an SSI individual is eligible for past due benefits in an amount which (after reimbursement for IAR and attorney/nonattorney fees) equals or exceeds 3 times the individual Federal Benefit Rate, plus any federally administered State supplement, installment payments must be paid. | |
