Abstract:
In Smith v. Berryhill , the Supreme Court held that Appeals Council dismissals for timeliness are "final decisions" made after a hearing, thus they are subject to judicial review under 42 U.S.C. section 405(g). We will update our regulations to comply with the Supreme Court’s decision. |
