Title: Designated Placements Requirements Under Titles IV-E and IV-B for LQBTQ+ Children; Rescission 
Abstract:

The Administration for Children and Families is proposing to remove 45 CFR section 1355.22, Designated Placements Requirements Under titles IV-E and IV-B for LGBTQI+ Children (Designated Placement) which was published in a final rule on April 30, 2024 (89 FR 34818). The Department is also proposing to remove the final rule amendments to 1355.34(c)(2)(i) to monitor compliance of Designated Placement requirements through the Child and Family Services Reviews (CFSR). The final rule established required procedural steps for title IV-B/IV-E agencies to take to provide Designated Placements and added requirements for foster care providers of these placements. These regulations contradict this Administration’s policies. On June 13, 2025, the U.S. District Court for the Eastern District of Texas issued a final judgment in State of Texas v. U.S. Department of Health and Human Services, et al. No. 6.24-cv-348-JDK, vacating the final rule in its entirety.
