| Title: Rescission of Interest Prohibition in the Principles for Determining Costs at Hospitals Under Federal Grants, Contracts, and Cooperative Agreements | |
| Abstract: This Notice of Proposed Rulemaking (NPRM) would rescind the current prohibition against interest as an allowable expense. The recision applies only to interest endured for new construction, facility acquisitions, and interest debt to acquire or replace facility acquisitions. It makes the Hospital Cost Principles consistent with the Office of Management and Budget circulars for Colleges and Universities (OMB Circular A-21), Non-Profit Institutions (OMB Circular A-122), and State and Local Governments (OMB Circular A-87) concerning the allowance of interest debt. These other principles were revised in the early 1990s, but the Hospital Cost Principles were not. In 2000, the current interest request waiver process was established as a temporary practice to align the Hospital Cost Principles with A-21 and A-87 until a permanent revision could be published. Since then, 12 such waivers have been granted by the Department. The standards in this NPRM would be the same as those in A-21 and A-87. This NPRM establish the Department of Health and Human Services as the proponent agency for appendix E of 45 CFR part 74 with inherent responsibility to review, approve, and deny requests for waiver to Hospital Cost Principles. | |
