Abstract:
Rule would rescind special rules at 43 CFR 8341.2 and designation criteria at 43 CFR 8342.1 and make conforming changes throughout part 8340. Section 8342.1 requires the BLM to designate all areas and trails for public off-road vehicle use in a manner that minimizes user conflicts and impacts to resources. The substantive requirement to minimize user conflicts and resource impacts is not mandated by statute. The special rules found at 43 CFR 8341.2 are unnecessarily redundant and less useful to public land management considering the BLM’s Temporary Closure and Restrictions regulations found at 43 CFR subpart 8364 and therefore should be considered for elimination. |
