This direct final rule (DFR) rescinds the U.S. Fish and Wildlife Service’s (Service) regulations at 50 CFR 85, which contain general provisions for the Clean Vessel Act Grant Program (CVA) authorized under the Dingell-Johnson Sport Fish Restoration Act. This DFR removes redundant and outdated sections. A review comparing 50 CFR 85 with existing statutes and regulations confirmed that all essential provisions are already addressed in: 2 CFR 200; 50 CFR Part 80; and the statutory authority. 

Rescinding 50 CFR 85 will not reduce oversight or program integrity. Instead, it eliminates duplication, removes unnecessary restrictions, and allows the Service to respond more effectively to legislative changes, market conditions, and program needs. The removal will maintain program goals and preserve the Federal-State partnership. By administering the CVA grant program through a Notice of Funding Opportunity (NOFO) instead, we will provide stakeholders with clear, consistent guidance and have greater flexibility to efficiently administer CVA awards.
