| Abstract: This final rule will correct the Code of Federal Regulations (CFR) to reflect that the West Virginia northern flying squirrel is again listed under the Endangered Species Act (ESA). Following litigation, the final rule delisting the species was vacated by court order, thereby immediately reinstating ESA protections for this species. As a result, this rulemaking is a nondiscretionary administrative action to revise the CFR to be in compliance with the court order. | |
