Abstract:
This rule would define various terms used in the regulations under 50 CFR part 21 regarding issuance of permits for activities involving migratory birds. This rule is being proposed to be responsive to conflicting judicial opinions and will codify the U.S. Fish and Wildlife Service’s longstanding treatment of incidental take under the Migratory Bird Treaty Act. This rule would clarify that the MBTA's prohibitions on taking and killing migratory birds includes foreseeable, direct taking and killing that is incidental to otherwise lawful activities. |
