As directed in Department of the Interior Secretary’s Order (SO) 3418, the Service will revise provisions of the 2024 final rule (April 5, 2024; 89 FR 24300) that revised portions of 50 CFR part 424. The 2024 rule was promulgated jointly with the National Marine Fisheries Service; therefore, the proposed rule to revise the regulations in part 424 will require coordination with that agency. The resulting rulemaking action will clarify, interpret, and implement portions of section 4 of the Endangered Species Act concerning the procedures and criteria used for adding, removing, or reclassifying species on the Lists of Endangered and Threatened Wildlife and Plants and designating critical habitat.
