| Title: Administrative Appeal Process for "Bad Man" Treaty Provision Claims | |
| Abstract: This rule would establish an administrative appeals process for claims made under the bad man provisions of treaties with Indian tribes. These treaty provisions generally provide that if an official of the United States commits a wrong against the person or property of a person or tribal member, the United States will compensate the tribal member for the loss sustained. Currently, there is no administrative process to resolve these claims; instead, the claimant must file suit in Federal Claims Court. This rule would establish an administrative process for filing these claims. | |
