Title: ●Natural Resource Damage Assessment and Restoration--Hazardous Substances 
Abstract:

The existing regulation provides procedures that natural resource trustees may use to evaluate the need for and means of restoring, replacing, or acquiring the equivalent of public natural resources that are injured or destroyed as a result of releases of hazardous substances. The current rule has a section on ‘Type A’ procedures which allow trustees to use a standardized methodology for performing Injury Determination, Quantification and Damage Determination that requires minimal field observation. The two procedures are used for coastal and marine environments, and Great Lakes environment and utilize a computer model developed in 2000. Over 20 years have passed since the creation of the models which are not applicable to all situations nor are updated enough to deal with current situations. The Department is interested in revising the regulations for the Type A only to account for the use of various models for different environments and to allow for a methodology that is not technology specific.
