Title: Claims Under the Radiation Exposure Compensation Act; Requirements for Submission of Identification Records 
Abstract: This rule amends Department of Justice regulations implementing the Radiation Exposure Compensation Act, 42 U.S.C. section 2210 note (2006). This rule amends existing regulations addressing the submission of documentation to establish a claimant's identity. The amended regulations (1) allow the submission of third-party affidavits in lieu of birth, death and marriage certificates, in cases where (a) it is impossible for the claimant or eligible surviving beneficiary to submit such identification documentation, or (b) in the case of Native American claimants who are not required to provide those records, affidavits would be permissible when the tribes' recordkeeping office has no such identifying information; (2) relax the current regulation requiring claimants or eligible surviving beneficiaries to provide certified or original documentation to establish identity by permitting the submission of photocopies; and (3) revise payment procedures, in certain situations, to permit partial payment of claims where multiple potential beneficiaries have been identified, but the Department lacks sufficient evidence to establish their eligibility as a beneficiary.
