Abstract:
The Department of Justice proposes to establish a process for reviewing state bar complaints and allegations against its attorneys. Under the proposed rule, before bar disciplinary authorities may undertake any investigative steps or otherwise seek information from a Department attorney in response to allegations that a current or former Department attorney violated an ethics rule while engaging in that attorney’s duties, the Department will have the right to review the allegations in the first instance. If the Department determines that the attorney did not violate any ethics rule, that finding will be final and conclusive. |
