| Title: Suspension of Deportation and Special Rule Cancellation of Removal for Certain Nationals of Guatemala, El Salvador, and Former Soviet Bloc Countries | |
| Abstract: On November 19, 1997, President Clinton signed the Nicaraguan Adjustment and Central American Relief Act (NACARA), enacted as title 2 of Pub. L. No. 105-100, 111 Stat. 2160, 2193 (1997) (as amended by Technical Corrections to the Nicaraguan Adjustment and Central American Relief Act, Pub. L. 105-139, Stat. 2644, (1997)). Section 203 of NACARA provides that certain Guatemalans, Salvadorans, and nationals of former soviet Bloc countries are eligible to apply for cancellation of removal under the standards for suspension of deportation that existed prior to enactment of the Illegal Immigration and Immigrant Responsibility Act of 1996 (IIRIRA). To implement the new cancellation of removal provisions efficiently and expeditiously, the Attorney General has decided to integrate adjudication of cancellation of removal requests into the affirmative asylum process. Traditionally, only immigration judges have had authority to grant suspension of deportation and, after implementation of IIRIRA, cancellation of removal, to eligible aliens in the context of deportation or removal proceedings. The proposed rule authorizes asylum officers to grant cancellation of removal under section 203 of NACARA to certain qualified aliens who have asylum applications pending with the Service, and to their qualified dependents. The rule also sets forth the process for the new adjudication program. | |
