Title: ●Fingerprint and Photograph Requirements for Applications 
Abstract:

The proposed rule amends ATF regulations to remove the requirement that responsible persons ("RPs”) attach a fingerprint card to their ATF Forms 5320.23, National Firearms Act ("NFA”) Responsible Person Questionnaire ("Form 23”), which entities submit with their ATF Forms 5320.1, Application to Make and Register a Firearm ("Form 1”), ATF Forms 5320.4, Application for Tax-Paid Transfer and Registration of Firearm ("Form 4”), or ATF Forms 5320.5, Application for Tax-Exempt Transfer and Registration of Firearm ("Form 5”). ATF also proposes amending its regulations that require individuals to include two fingerprint cards with their ATF Forms 1, 4, or 5, to instead require only one fingerprint card. In addition, ATF proposes to permit RPs to submit copies of their photo identification documents with their Forms 23, and to permit individuals to do the same with their Forms 1, 4, 5 and their ATF Forms 5630.7, Special Tax Registration and Return National Firearms Act (NFA) ("Form 7”), as an alternative to the current requirement that both groups must submit 2” x 2” photographs. A subset of RPs may still need to submit fingerprints and a subset of RPs and individuals may still need to submit photographs (instead of copies of identification documents), upon request, if necessary to efficiently process their background checks.
