Abstract:
This rule proposes to amend ATF regulations in response to court decisions finding ATF final rule on Factoring Criteria for Firearms with Attached ‘Stabilizing Braces’ to be in violation of the Administrative Procedure Act. A number of courts have enjoined, stayed, or vacated the final rule, which has rarely been in effect since its publication. This rule would remove from the regulatory definitions of rifle the two paragraphs that defined the term designed or redesigned, made or remade, and intended to be fired from the shoulder, returning them to the previous definitions of rifle in the regulations, which tracked the GCA and NFA’s statutory definition and did not further define intended to be fired from the shoulder. |
