| Title: Worker Adjustment and Retraining Notification; Amendments for Clarifications | |

Abstract:
The Department of Labor’s (Department) Employment and Training Administration (ETA) is considering updating the regulations at 20 CFR part 639 to clarify the application of single site of employment as it relates to remote workers under the Worker Adjustment and Retraining Notification (WARN) Act. Specifically, this proposed rule will clarify that remote workers meet the definition of out-stationed employees under the WARN Act regulations. This clarification is in response to court decisions which have varied in the interpretation of this provision and a number of questions about the issue from employers and other entities. Given the current prevalence of remote work, this clarification is necessary to make clear that formal WARN notification applies to remote workers. |
