Title: ●Application of the Fair Labor Standards Act to Domestic Service 
Abstract:

Section 13(a)(15) of the Fair Labor Standards Act (FLSA or the Act) provides an exemption from the Act’s minimum wage and overtime pay requirements for domestic service employees engaged in providing companionship services for individuals who (because of age or infirmity) are unable to care for themselves. Section 13(b)(21) of the FLSA provides an exemption from the Act’s overtime pay requirement for domestic service employees who reside in the household in which they provide services. This notice indicates that WHD will review regulations implementing sections 13(a)(15) and 13(b)(21) of the FLSA.
