| Title: Longshore and Harbor Workers' Compensation Act: Civil Monetary Penalties Procedures | |
|
Abstract:
The Office of Workers’ Compensation Programs (OWCP) administers the Longshore and Harbor Workers’ Compensation Act and the Longshore Act’s extensions. The Longshore Act sets out monetary penalties that OWCP may assess against Longshore employers or their insurance carriers when they fail to timely file certain reports or falsify those reports, or when employers discriminate against employees for exercising their rights under the Act. In 2023, OWCP proposed new rules for imposing and reviewing civil money penalties prescribed by the Longshore Act. OWCP has decided not to pursue this Longshore rulemaking at this time and is withdrawing this action from the Regulatory Agenda. |
