Abstract:
On April 23, 2025, President Trump issued Executive Order (E.O.)14281, Restoring Equality of Opportunity and Meritocracy. Consistent with E.O. 14281, the Department of Labor plans to issue a direct final rule amending its regulations implementing Title VI of the Civil Rights Act of 1964 (Title VI) to eliminate disparate-impact liability. These amendments align the conduct prohibited by the Department’s regulations with Title VI’s original public meaning, avoid constitutional concerns, reduce compliance costs, and serve the public interest. |
