Abstract:
This regulation change allows the Department to authorize an immediate family member of an alien properly classified as an A-1, A-2, G-1, G-2, G-3, or G-4 principal nonimmigrant to obtain a different nonimmigrant visa, maintain current nonimmigrant visa status, or change to a different nonimmigrant visa status without being restricted to the principal’s A-1, A-2, G-1, G-2, G-3, or G-4 nonimmigrant visa category. Recent cases involving changes of status have led to increased interest in revising the A/G required rule to provide the Department discretion in its application, with the goal of avoiding potential bilateral irritants. |
