FinCEN is amending the regulations implementing the Bank Secrecy Act (BSA) regarding reports of foreign bank and financial accounts (FBAR). The proposed changes are intended to clarify which persons will be required to file reports of foreign financial accounts and what information is reportable. Specifically, the proposed changes are intended to expand and clarify exemptions for certain U.S. person with signature or other authority over, but no financial interest in, foreign financial accounts solely due to their employment. The proposed changes are also intended to reduce the scope of special rules permitting U.S. persons to report limited account information when they have financial interest in or signature authority over 25 or more foreign financial accounts.
