Abstract:
The Department of Homeland Security (DHS) proposes to amend its U nonimmigrant status regulations by defining a bona fide determination (as provided in section 214(p)(6) of the Immigration and Nationality Act) and introducing an employment authorization process for bona fide petitions based on a favorable grant of discretion. DHS also proposes to amend the waiting list. Lastly, DHS proposes to amend its regulations to conform to two pieces of legislation: the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 and the Violence Against Women Act Reauthorization Act of 2013.
