Abstract:
This procedural rule would amend Transportation Security Administration (TSA) regulations to increase the availability of streamlined civil penalty procedures. TSA charges a civil penalty when an individual in violation of TSA requirements presents a weapon, explosive, or incendiary device during airport screening or in checked baggage. Currently, when the civil penalty is less than $5,000, an expedited civil penalty procedure is available. This cap for streamlined cases was established in 1996 and has not been adjusted for inflation since that date. Without this rule, cases where the amount of civil penalty is above $5,000 requires a lengthy process that can require multiple notices, multiple hearings and an Administrative Law Judge decision. Expanding the availability of the streamlined civil penalty procedures would reduce costs by improving efficiency in factually uncomplicated cases. This rule would not revise penalties applicable to specific offenses, affect due process rights, or in any way modify the streamlined procedures. |
