Title: Family Educational Rights and Privacy
Abstract: These regulations are needed to implement section 444 of the Improving America's Schools Act of 1994, (Pub. L. 103-761). That provision amends the Family Educational Rights and Privacy Act to specify certain requirements with regard to the disclosure of information from education records, the right of parents to inspect and review certain records maintained on their children by State educational agencies, and the maintenance and disclosure of disciplinary information found in education records. The provision also removes, in certain law enforcement instances, the requirement that schools notify parents or students before complying with a subpoena or court order. The regulations were developed in accordance with the Department's Principles for Regulating.
