View Rule

The U.S. Department of Energy (DOE) is establishing a procedure through which an interested party can identify an error shortly after DOE issues a rule establishing or amending an energy conservation standard and request that DOE correct the error. As part of this process, DOE will, after issuing such a rule, not publish a final rule subject to this process for 30 days to allow the public an opportunity to review the rule and submit error-correction requests. DOE received petitions to amend the rule and several timely comments on those petitions. In response to these submissions, DOE modified the final rule, which published on August 24, 2016, see 81 FR 57745.

Overall Description of Deadline: This rulemaking is part of a settlement agreement reached between DOE and a number of manufacturers who produce refrigeration systems for walk-in coolers and walk-in freezers. DOE agreed to issue a document within a prescribed timeline to address the manner in which error correction will be handled by DOE in future rulemakings.
