View Rule

Through this interim final rule, DOE is rescinding part 861 of title 10, Code of Federal Regulations.  Title 10 CFR Part 861 was originally published on December 30, 1976, to facilitate the control of traffic on the Nevada Test Site, now known as the Nevada National Security Site.  The rule addresses various aspects of traffic control, including speed limits, traffic signs and signals, stopping and yielding, and parking restrictions. They also outline penalties for violations and procedures for posting and distributing the regulations.  Pursuant to Executive Order 14192, Unleashing Prosperity through Deregulation, and E.O. 14270, Zero-Based Regulatory Budgeting to Unleash American Energy, DOE reviewed part 861, Control of Traffic at the Nevada Test Site, and determined this rule is obsolete. The authority for this rule is the Atomic Energy Act of 1954, as amended, 42 U.S.C. 2011 et seq.
